These Terms and Conditions govern the use of services provided by Fencing Wichita Falls TX and our website https://fencingwichitafallstx.com/. By using our services, you agree to be bound by these terms and conditions, any additional terms and policies referenced herein, and any subsequent modifications. If you do not agree to these terms, please do not use our services.


Fencing Wichita Falls TX provides fencing installation, repair, and maintenance services for residential and commercial properties in Wichita Falls, TX and surrounding areas. Our services include, but are not limited to:

  • Fence installation – we install wood, vinyl, chain link, aluminum and other fencing materials.
  • Fence repair – we repair damaged or broken fencing and gates.
  • Fence staining and sealing – we apply protective finishes to extend the life of wood fences.
  • Fence cleaning – we provide pressure washing and cleaning services for fences.
  • Custom fencing design and installation.
  • Security and privacy fencing solutions.
  • Temporary fencing rentals for events.
  • Fence inspections and maintenance plans.
  • Removal and disposal of old or unwanted fencing.

Service Limitations

We reserve the right to refuse service to anyone for any reason at any time. Some reasons we may refuse service include:

  • Dangerous or threatening behavior towards our staff.
  • Outstanding unpaid balances or history of late payments.
  • Requests for services outside our area of operation or expertise.
  • Illegal or unethical activities.
  • Unsafe working conditions.

We will not install fences on property lines or boundaries without all affected parties’ consent. Property line disputes must be resolved before fencing work can begin.


We provide written estimates for all services based on your requirements and our standard rates. Unless stated otherwise, estimates are valid for 30 days. Estimates are not binding contracts for services. The final invoice may be higher or lower than the estimate. Price increases may occur due to changes in project scope, unforeseen conditions, or price increases for materials and labor. We will notify you of significant price increases that exceed 10% of the original estimate.


A non-refundable deposit of 50% of the total estimate is due upon signing the estimate to secure project dates and materials. The remaining balance is due upon completion of work. Additional work not included in the original estimate will be billed separately.

We accept cash, check, and major credit cards. A 3% transaction fee applies to credit card payments. Checks returned for insufficient funds will incur a $35 fee.

Outstanding balances must be paid within 30 days of the invoice date. Accounts over 30 days past due will incur late fees of 1.5% per month. We reserve the right to stop work and withhold services for past due accounts.

If you fail to make full payment when due, we may terminate your service, initiate collection actions, and suspend work on other projects for you. You will be responsible for all fees associated with collection of unpaid balances, including, but not limited to, collection agency fees, court costs, and attorney fees.


We require a minimum of 5 business days advance notice to schedule non-emergency services. Emergency repair services are scheduled as soon as possible, depending on technician availability.

Scheduled dates are not guaranteed and may be adjusted due to weather delays, staffing issues, or other unforeseen circumstances. We will notify you as soon as possible of any schedule changes.

Cancellation Policy

You may cancel scheduled services up to 48 hours in advance of the scheduled date without penalty. Cancellations within 48 hours will incur a cancellation fee of $250 or 50% of the estimate, whichever is less. specialty ordered or custom fabricated materials are non-refundable if cancelled after placement of order.

Service Hours

Our regular service hours are Monday to Friday from 8am to 5pm. Weekend, evening, and holiday service may be available for an additional fee. Please contact us for details.

Access to Property

You must provide clear access to all areas that require service. For fence installations, you must clearly mark all property lines and underground utilities. We will not be liable for damage to unmarked underground pipes, wires, sprinkler systems, or other objects. Trees, plants, and other landscaping may be removed or damaged to facilitate fence installation. Notify us in advance of any areas requiring special care or avoidance.

You must secure pets to allow our safe access. We reserve the right to halt work if pets pose a safety risk to our crew. Any delays or rescheduling caused by pets will result in additional fees.

If you are not present during the time of service, you authorize our crew to access the property as required to perform services. We are not liable for theft or damage inside the property.

Permits and Governing Laws

You are solely responsible for determining and obtaining any necessary permits, inspections, homeowners association approvals, or other governance requirements prior to work commencing. We can provide guidance on permit requirements at your request. Failure to obtain required permits or approvals may result in fines or removal of installed fencing at your expense.

All services provided shall comply with applicable federal, state and local laws and regulations. If any applicable law or regulation requires a higher or different standard of performance than these terms, the higher or different standard shall prevail over these terms.


We will discuss material options with you and make recommendations based on your needs. However, you are responsible for selecting the specific fencing materials. We assume no liability for defects, performance, or aesthetics of customer-selected materials.

Unless otherwise agreed, all materials provided for services become your property upon completion and payment. Exceptions include rental equipment and surplus materials removed by our crew.

We normally salvage usable fencing materials during removal and repairs. You may specifically request to keep salvaged materials, which will be left onsite. An additional fee may apply.


We provide a one year warranty on all labor provided. This warranty covers defects in workmanship only. Damage caused by wear and tear, improper maintenance, abuse, or acts of nature are excluded.

Manufacturer warranties on fences and other installed materials will apply if valid. We make no additional guarantees about life expectancy or durability of installed materials. Proper maintenance is required to achieve expected lifespan of materials.

This warranty becomes void if you fail to make payments as due or if another contractor alters our work without consent.

To make a warranty claim, inspect the warranted issue or defect then contact us in writing with photos and a full description within the one year period. You must allow us access to the property to evaluate any warranty claim.

We reserve the right to repair, replace, or refund services at our discretion to satisfy any valid warranty claims. The original warranty period still applies and is not extended for any warranty work provided.

Limitation of Liability

We will provide services in a professional manner, but are not liable for your complete satisfaction with the project outcome. Fencing may not fully contain pets, provide absolute privacy or security, or completely prevent trespassing in all cases. We do not guarantee fence alignments will conform to all property lines, codes, neighborhood covenants, or your precise expectations. You maintain responsibility for verifying property boundaries.

Our maximum liability for any reason relating to services provided is limited to the amount paid for those specific services only. We are not liable for incidental, consequential, punitive or special damages under any circumstances.

We are not liable for pre-existing defects, deficiencies, or problems that become apparent before or during the course of our work. Existing fence posts, foundations, and underground footings may fail over time for reasons unrelated to our workmanship.

Release of Liability

You understand and voluntarily assume certain risks inherent with fence installation and related services. These include, but are not limited to:

  • Utilities – Potential for contact with underground pipes, wires, etc that may be inaccurately marked or not anticipated. We are not responsible for damage or repair to underground utilities or other unmarked objects.
  • Terrain – Risk associated with uneven terrain, slopes, ditches, embankments, retaining walls, landscaping, etc that may be on your property.
  • Hazardous Materials – Risk of exposure to lead paint, treated lumber, environmental toxins, insecticides or other hazardous materials that may be present on the premises.
  • Collateral Damage – Potential for unintended damage to property including landscaping, sprinklers, hardscape, or other improvements near the fence line. Some removal of plants, trees, etc may be necessary.
  • Personal Injury – Risk of cuts, lacerations, puncture wounds or other minor personal injuries from working with fencing materials and construction tools. Proper safety precautions will be observed but cannot entirely eliminate risks.
  • Other Unforeseen Conditions – Risk of delays, complications, or losses arising from unanticipated factors,difficult access, unmarked property lines, unknown defects and the overall nature of outdoor construction work.

You release Fencing Wichita Falls TX from liability for the above inherent risks and any resulting damages or losses. We advise you to take prudent measures to protect valuable landscaping and property features near the planned fence line prior to our work commencing.


You agree to indemnify, defend and hold harmless Fencing Wichita Falls TX and its employees, affiliates, contractors and agents from any claims, damages, losses, costs and expenses relating to injury or death of any person, or damage to your property or home arising out of your negligence, willful misconduct, work of any third parties, or defects in customer-supplied materials.
